Consent:

By checking the consent box, and submitting the application you “Buyer” agrees to the Dreamstar Digital Ltd alias Kweli.shop’s (vendor) flexible payment terms and conditions which apply to you upon approval and payment of the first instalment. If you are married, you confirm that your spouse is aware and has agreed to your participation in the flexible payment option or credit transaction engagement herein.

Payments:
The Buyer shall pay the vendor according to their selected and approved payment plan until the order amount is fully paid. Payments may be made by bank transfer, mobile money, Flexipay, or cash, as advised by the vendor at the time of approval. Buyers opting for the “Save Now, Buy Later” option may pay as frequently as possible.

Deliveries:
Delivery of the ordered items shall be processed according to the approved payment plan. This means delivery will occur within 3-7 working days from the time of receiving the required down payment, upon receipt of 7 consistent payments for the 10 flexible payments plan or 4 consistent payments for the 6 flexible payments plan, and upon receipt of full payment for the “save now, buy later” plan. The Buyer shall be responsible for any applicable delivery charges unless otherwise agreed upon in writing by both parties.

Ownership:
Ownership of the product/equipment shall remain with the Vendor until the Buyer has made all payments due under this Agreement. Once the Buyer has made the final instalment payment, ownership of the product/equipment will be transferred to the Buyer.

Stock and Model Upgrades:
– If the model of the product a Buyer is paying for changes before the time of delivery, the order will be automatically upgraded to the latest model, with any price changes not applying to the Buyer. In the event of a delay in receiving the ordered model or the upgraded model at the time of delivery, the company will either recommend a similar item to the Buyer or request that the Buyer wait for the exact model they initially selected.

Default; Refusal to Pay Outstanding Amounts:
If the Buyer fails to make any payment as per the agreed terms or refuses to pay outstanding amounts, the Vendor shall have the right to terminate this Agreement and reclaim the product/equipment. The Buyer shall be responsible for any costs associated with the collection of the product/equipment.

Change of Payment Plan or Product(s):
A Buyer who has not yet paid more than 50% of their plan amount may request to switch to a different plan, which could involve a different product or payment schedule, at no extra cost and without facing any penalties or deductions. Buyers who have paid more than 50% of their plan amount may still request to switch to a different plan, including a different product or payment schedule. However, this change will incur a cost equivalent to 10% of the original plan amount.

Termination by the Buyer:
A buyer may request to terminate their flexible payment plan at any time, provided the ordered item(s) have not yet been delivered. Refunds for payments made before the termination date will be issued, with a deduction of 20% of the total instalment sum already paid. The refunded amount will be disbursed to the buyer within 14 working days from the payment plan’s termination date.

Termination by the Vendor:
If the Buyer fails to make payments more than three consecutive times, the Vendor reserves the right to terminate an active flexible payment plan. In such cases, the Buyer will be refunded, with a deduction of 20% of the total instalment sum already paid. Additionally, a grace period will be granted if a Buyer cannot continue with payments for a certain period, provided the Buyer communicates this before termination is initiated. The refunded amount will be disbursed to the Buyer within 14 working days from the payment plan’s termination date.

Warranty:
The Vendor warrants that the product/equipment is free from defects in material and workmanship and comes with a manufacturer’s warranty and the vendor’s guarantee of not less than 12 months from the time of delivery of the product. provided that the warranty terms are fulfilled, the product/equipment shall be repaired or replaced.

Governing Law:
This Agreement shall be governed by and construed under the laws of Uganda.

Entire Agreement:
This Agreement constitutes the entire agreement between the Buyer and Vendor and supersedes any prior agreements or understandings, whether written or oral relating to the subject matter herein.
